If for the director of an enterprise the presence of a large number of employees creates certain difficulties associated with registration, taxes, accounting, etc., due to outstaffing, all these unpleasant worries can be assigned to the so-called provider that provides the corresponding services. All employees remain at their workplaces, while officially they are already working on a campaign to provide outstaffing services. The owner of the company and the provider enter into an agreement on the provision of labor, and in this case, the latter assumes all obligations for staffing. Thus, the contracting company in some cases retains only the administrative staff.

Outstaffing services can be indispensable when seasonal workers or employees are required to complete a specific project. It’s not very convenient to hire people to work, and after a short time to dismiss. Therefore, it is more practical to turn to the services of an outstaffer, who, as a rule, already has a whole staff of skilled workers in various areas.

It may seem that the most unprotected side in the outstaffing procedure is the employees themselves. The employer does not bear responsibility for them, since it does not have legal relations with staff. And in fact, their activities are not related to the provider company. But in reality, any employee in this situation is bound by obligations with the outstaffer party, and she, in turn, bears all responsibility on the basis of contractual relations with a particular person. Here the rules are simple – no matter which party you are, carefully study the contract or agreement before signing. Only in this way will you avoid misunderstandings when questions arise about your rights and obligations.
